Holiday Excursion Accident Compensation Claims

Holiday excursions — the day trips, coach tours, boat trips, adventure activities, and cultural outings that form part of many UK holidays abroad — produce a substantial volume of personal injury claims each year. From coach accidents in mountain regions through to water sports injuries, quad bike crashes, and walking tour falls, excursion incidents involve specific legal questions about who is liable and how to bring claims back to UK courts. The critical issue is typically whether the excursion was sold as part of a package — which dramatically changes the legal route.

In this guide

This guide explains how holiday excursion accident claims work, the Package Travel Regulations framework, and how to start a claim on a no win no fee basis.

How Excursions Are Categorised

For UK injury claim purposes, holiday excursions fall into three categories with very different legal implications:

Excursions Sold as Part of the Package

Where the excursion was sold by the UK tour operator or directly bookable through the operator at the time of original booking:

  • Package Travel and Linked Travel Arrangements Regulations 2018 apply
  • UK tour operator is liable for excursion provider failures
  • UK court proceedings against UK tour operator
  • English/Welsh law applies

Excursions Sold by Resort Reps During the Holiday

Where the excursion was sold by the package operator’s representative at the resort:

  • Often treated as part of the package under the 2018 Regulations
  • UK tour operator typically liable
  • Case law has expanded this category over time

Independent Excursions

Where the excursion was booked directly with a local operator (hotel desk, street vendor, online direct booking):

  • Package Travel Regulations do not apply
  • Direct claim against foreign operator required
  • Foreign courts and foreign law
  • Often impractical to pursue

For independent excursions, travel insurance is the primary protection.

Common Excursion Accident Types

Coach Tour Accidents

A significant UK excursion claim category. Common scenarios:

  • Crashes on mountain roads (common in alpine and Mediterranean tours)
  • Bus rollovers
  • Falls during boarding/alighting
  • Inadequate seatbelt provision
  • Driver fatigue accidents
  • Inadequate vehicle maintenance

Coach accidents can produce serious injuries, particularly where vehicles rolled or fell from mountain roads. Significant UK cases have addressed coach crash damages.

Boat and Water Tour Accidents

  • Slips on wet decks
  • Falls during boarding/alighting
  • Collisions
  • Inadequate life jacket provision
  • Drowning incidents
  • Banana boat and inflatable injuries

For boat excursions, the Athens Convention 1974 may apply (2-year time limit) — see our cruise ship accident claims guide for the framework. Smaller boat tours may fall outside Athens and follow standard tort principles.

Quad Bike and ATV Accidents

Particularly common in Greek islands, Spanish resorts, and Portuguese resorts:

  • Inadequate safety briefing
  • Inadequate helmet provision
  • Defective vehicles
  • Inadequate suitable terrain
  • Inadequate supervision
  • Allowing unlicensed operation

Where the excursion was sold by the package operator, claims regularly succeed for inadequate safety standards.

Jet Ski Accidents

  • Inadequate safety briefing
  • Defective equipment
  • Inadequate supervision of beginners
  • Allowing operation in inappropriate conditions
  • Failure to provide adequate safety equipment

Banana Boat and Inflatable Accidents

  • Falls causing whiplash and back injuries
  • Inadequate life jackets
  • Excessive speed by towing boats
  • Inadequate supervision

Parasailing Accidents

  • Equipment failures
  • Inadequate harness fitting
  • Operation in inappropriate weather
  • Operator inexperience

Adventure Activity Accidents

Including zip-lining, white water rafting, paragliding, rock climbing:

  • Equipment failures
  • Inadequate safety briefing
  • Inappropriate participant selection
  • Inadequate supervision
  • Operating in inappropriate conditions

Walking and Cultural Tour Accidents

  • Falls on uneven terrain
  • Falls at archaeological sites
  • Falls on stairs at attractions
  • Inadequate warnings about hazards
  • Inadequate accommodation of mobility-impaired participants

Donkey, Camel, and Horse Trekking Accidents

Particularly common in Mediterranean and North African destinations:

  • Falls from animals
  • Bites and kicks
  • Inadequate animal welfare leading to unpredictable behaviour
  • Inappropriate participant pairing (heavy riders, novices)

Theme Park and Water Park Accidents

  • Slides causing injury
  • Failed safety harnesses
  • Inadequate height/weight restrictions
  • Operator errors
  • Defective rides

The Package Travel Regulations and Excursions

A specific Package Travel Regulations concept matters for excursions:

“Improper Performance”

The UK tour operator is liable for “improper performance” of any element of the package. For excursions, this means:

  • Tour operator must ensure excursion providers meet reasonable safety standards
  • Local standards apply, but tour operator must have inspected and contracted with reasonable providers
  • Tour operator cannot disclaim liability by pointing to the foreign provider

Standards Applied

UK courts apply:

  • Local regulatory standards (the minimum)
  • Reasonable safety expectations (often higher)
  • Specific case law on holiday excursion duties

Where local standards are clearly inadequate, UK courts have applied general safety expectations.

Time Limits

For package excursion claims against UK tour operators, the standard 3-year UK personal injury time limit applies. For boat excursions, the Athens Convention 1974 may impose a 2-year limit. For independent excursion claims abroad, local limits apply (typically 1-5 years). See our time limits guide.

What Compensation Could You Receive?

Excursion accident compensation follows UK Judicial College Guidelines plus special damages:

  • Soft tissue injuries — typically £2,000 to £10,000
  • Fractures — typically £8,000 to £75,000
  • Serious orthopaedic injuries — typically £30,000 to £150,000
  • Head injuries — typically £8,000 to £400,000+
  • Catastrophic injuries — typically £500,000 to £5 million+
  • Fatal cases — Fatal Accidents Act 1976 claims

Special Damages

  • Holiday cost recovery (where holiday was ruined)
  • Repatriation costs
  • Lost earnings during recovery
  • Treatment costs
  • Future loss of earnings
  • Future treatment costs

Evidence That Strengthens an Excursion Claim

  • Package booking confirmation
  • Excursion booking confirmation
  • Resort rep receipt (if sold at resort)
  • Names and contact details of any witnesses
  • Photographs of the location, equipment, vehicles
  • Local incident report
  • Police report (for serious incidents)
  • Medical records from local treatment
  • Subsequent UK medical records
  • Receipts for any expenses
  • Records of safety briefings (or absence thereof)

No Win No Fee Excursion Claims

Package excursion claims run on no win no fee Conditional Fee Agreements. The success fee — capped under LASPO 2012 at 25 per cent of general damages and past losses (future losses excluded) — is deducted from compensation. See our how no win no fee works guide.

Common Questions About Excursion Accidents

I booked a TUI excursion that crashed. Can I claim?

Yes, almost certainly. TUI excursions are part of the package under the 2018 Regulations. TUI is jointly liable for any failures by the excursion provider. Coach crashes producing serious injury have produced substantial UK settlements against major tour operators. The case is brought against TUI in UK courts applying English law.

My rep sold me an excursion that injured me. Is the operator liable?

Often yes. Where the resort rep was acting on behalf of the UK tour operator and the excursion was effectively part of the package (or a “linked travel arrangement”), the tour operator is typically liable. UK case law has expanded this category over time. Specialist legal advice will clarify your specific situation.

I booked a quad bike excursion directly with a local company. Can I claim?

Much harder. Direct bookings with local operators fall outside the Package Travel Regulations. You would need to sue the local operator in foreign courts, which is impractical for most cases. Travel insurance personal injury cover is the primary protection for independent bookings.

I was injured on a banana boat. The safety briefing was poor. Can I claim?

Often yes, where the excursion was part of the package. Banana boat operators have duties to: provide adequate safety briefings, provide life jackets, operate at appropriate speeds, supervise participants. Where these were inadequate and you were injured, claims succeed against UK tour operators for package excursions.

My husband died on a holiday excursion. Can the family claim?

Yes. Fatal package excursion claims succeed under: Law Reform (Miscellaneous Provisions) Act 1934 (estate claim for losses to date of death), Fatal Accidents Act 1976 (dependency, bereavement award, funeral costs). UK courts handle these claims against UK tour operators. Settlements for fatal package excursion cases can be substantial. See our fatal accident compensation guide.

How long do excursion claims take?

Straightforward package cases settle within 12 to 18 months. Cases involving complex liability or severe injuries typically take 18 months to 3 years. Catastrophic cases can take 3 to 5 years. See our how long does a claim take guide.
