What is Santander payment protection insurance?

Loans, credit cards, and store cards are just some of the financial products that were sold to customers across the country by banks with the addition of opt-in PPI policies.

In short terms, PPI or payment protection insurance was an optional extra sold to offer peace of mind in the form of added financial security with purchases.

When choosing to opt-in for a financial product and its agreement there was the option to purchase PPI and this extra was often heavily promoted due to the fact that the brokers, sales reps, and banks selling, were financially incentivized through commissions.

In fact, many clients were entirely unaware that regular PPI payments were to be made on top of any interest or other associated agreement fees.

What is a Santander Plevin PPI claim?

The 29th of August 2019 marked the official end of PPI claims and quickly the adverts that had inundated our screens and radios on behalf of reclaim experts promising compensation were no more.

Unfortunately, customers who had an outstanding PPI claim were now unable to pursue or receive a refund as soon as the summer deadline lapsed.

PPI claims first came about as many customers who had chosen to add PPI to their agreements were completely oblivious to the hidden commission fees that could be earnt by their brokers, the banks, and the introducers associated with their sales.

Despite the deadline occurring over three years ago, a landscape-changing court case held at the Supreme Court led to a new avenue for potential PPI claims.

The Plevin PPI name comes from Mrs. Susan Plevin, who objected to being unable to claim against her own PPI purchase. The court ruling in her favour highlighted that “an undisclosed commission on PPI could result in an unfair relationship between the lender and consumer under the Consumer Credit Act 197”

With this new criteria, claims could now focus specifically on the sizable hidden fees and more Plevin cases came through from across the UK. The Plevin case has now made way for customers to claim solely based on the secrecy of the fees brokers, banks, and lenders made on behalf of a client.

To achieve a successful Plevin claim, customers must be able to demonstrate that substantial amounts of hidden commissions were earnt as a result of their agreement.

Rejected Santander PPI Claims

There are potentially thousands of customers who have previously submitted an unsuccessful PPI claim based on the former and more complex mis-selling criteria. With this in mind, such clients should check whether or not their agreement could fall under the revised Plevin standards.

If you have already submitted a payment protection insurance claim under the old mis-selling criteria, you may still have a Plevin case you could win.

The main difference between the two compensation processes is that the Plevin cases simply need to have included an undisclosed commission. In the past, PPI refund customers needed to prove mis-selling of the product itself which was potentially more difficult to do.

How to claim Plevin PPI from Santander

You have already filed a claim and it has been rejected (you may have a new one in light of the Plevin case)

If you bought your PPI after the 6th of April 2007 this could also be an option.

If you bought your PPI before the 6th of April 2007 and it is still ‘open’ after the 6th of April 2008 you should explore the possibility of both a refund and compensation.
