Home E Car & Property E Diesel Emissions

What is the diesel emissions scandal (also know as ‘Dieselgate’)?

‘Cheat devices’ were fitted to diesel cars to intentionally lower emission figures in laboratory testing. In real world driving, diesel cars were emitting up to 40 times more NOx than the official figures, causing harm to the environment and public health.

What am I claiming for?

You are claiming compensation from the car manufacturer for being deceived into thinking your diesel car was less harmful that it actually was. For example, you may not have bought the car if you knew about the ‘cheat device’, you may have paid more for the car than you should have, or you may have incurred costs to fix the car in order to meet emission standards.

Who is eligible to make a claim?

In order for your claim to stand a chance of success it is advisable you meet the following criteria.

Registered Keeper

You were the registered keeper of a diesel car or van in England or Wales that was made between 2007 and 2018.

New, leased or second hand

The vehicle you were the registered keeper for was either new, purchased second hand or leased.

Proof of Ownership

You can provide proof of ownership documents such as your purchase or lease invoice or finance agreement.

No longer owned

It’s ok if you no longer own the vehicle and it has now been sold on, you can still make a claim for compensation.

Vehicle makes

Your vehicle make was either Mercedes, Volkswagen, Audi, BMW, Vauxhall, Ford, Citroen, Peugeot, Renault, Nissan, Skoda, Jaguar, Volvo, Hyundai, and Land Rover. Please note we currently accept Mercedes only, but soon other makes will be available.

Are diesel claims worth it?

If you are considering whether a diesel emissions claim is worthwhile, the most simple route is to join a claim as part of a class action lawsuit. This means joining other claimants who may have also been misled about their emissions to form a larger case.

Common questions

Do You Offer No Win, No Fee?

If your claim is successful you pay a fee to the legal firm handling your case, these range from 20-40% and you will be told what the fee is when your claim is approved. If your claim isn’t successful, ‘ATE’ or ‘after the event’ insurance provided by the law firm will cover any legal fees you are liable for. Be aware, some ATE policies are capped, so please read the legal firm’s small print before signing any agreement.

How much could my claim be worth?

A claim can be worth anything from a few hundred pounds to as much as £10,000.

Can I cancel my claim?

You have a 14 day right to cancel policy. If you cancel your claim after that you may incur legal fees from the firm processing your case.

How long do claims take?

We will try to get a response from the vehicle manufacturer within four weeks. If your claim is settled out of court, you may get less than going to court but the claim will be settled much quicker. The VW court case is ongoing nearly three years later.

What is the deadline?

The deadline for VW cars was 31/12/21, however, there is no deadline yet for other manufacturers.
